In this agreement the “Customer” is the individual guest agreeing to the following terms and conditions for the Retreat by Clariness Collective Ltd. The “Organisers” are the individuals facilitating, co-hosting, and creating said Retreat. The Retreat under question is the ‘Reconnecting to Our Inner Artist’ retreat taking place from 27 August to 2 September 2022.
It is the customer’s responsibility to check the reservation and ensure that the particulars contained are correct.
The Customer attending this retreat shall pay Clariness Collective Ltd a strictly non-refundable deposit of £590 to confirm booking. The remaining balance can either be paid in full within 12 hour of paying the deposit, or it can be paid in instalments with a payment plan option. All instalments from the payment shall be paid by 25 June 2022. Payments shall be made in GBP pounds and should include any bank transfer fees, as well as any other applicable fees. The customer shall follow the procedure outlined by Clariness Collective Ltd to make the payment(s).
The total balance monies due shall be paid by the individual customer to Clariness Collective Ltd, for a place on a retreat when agreed on booking.
If payment of either the deposit or the balance is not received by the due date, Clariness Collective Ltd reserves the right to cancel the reservation of said customer(s) and retain the deposit.
REFUND & CANCELLATION POLICY: In the event of a cancellation made by a Customer, 50% of the total cost of the retreat - minus the £590 non-refundable deposit- is refundable up to 8 weeks prior to the retreat start date only, if and only if the retreat was paid in full by said Customer. Deposits and payments from the payment plan option are strictly non-refundable. In case the retreat needs to be rescheduled due to COVID-19 or any other unforeseen situation, guests will be offered new retreat dates or a voucher for a future retreat, but Clariness Collective Ltd will not offer refunds. No exceptions will be made to the cancellation and refund policy. By making the payment of your non-refundable deposit, the Customer agrees to this refund and cancellation policy.
Due to situations beyond its control, Clariness Collective Ltd reserves the right to change bookings and shall inform the customer as soon as possible in this event. Alternative arrangements will be offered, but Clariness Collective Ltd does not accept responsibility for any costs incurred, including airfare.
If there is any kind of issue, damage, and/or accident during the Retreat that is the customer’s fault or that the customer is involved in, in any shape, way or form, however unintentional, said Customer will be responsible for the associated charge(s) and legal consequences.
The customer will be responsible for his/her own health and safety during the Retreat. Clariness Collective Ltd or/and the Organisers are not liable if the customer puts their health and safety in danger, nor are Clariness Collective Ltd and the Organisers liable if an unintended accident, violence and/or natural disaster takes place, which puts the health and safety of the customer signing this agreement in danger.
The Customer is responsible for not putting the health and safety of others in danger during the Retreat.
The Customer is responsible for following any rules, procedures, and/or code of conduct put in place by the Organisers and Clariness Collective Ltd and the Retreat Venue. A failure to do so, as determined by the Organisers and Clariness Collective Ltd, gives the Organisers and Clariness Collective Ltd the right to expel them from the Retreat.
Clariness Collective Ltd is not held liable for flight costs, flight cancellations, or flight delays, or any other mode of transport to and from the retreat venue, before or after the retreat.
It is the Customer’s responsibility to ensure that they have all the relevant travel documentation, visa requirements, and health requisites up to date. It is also the Customer’s responsibility to arrive on time at the airport, or to other modes of transportation.
The Customer shall not use the property hired by Clariness Collective Ltd as the retreat centre venue, except for permitted use of the retreat activities. The customer shall not use the property for any offensive, noisy, dangerous, illegal, entertainment, immoral or improper purposes. The Customer shall not do anything which may be a nuisance or annoyance to Clariness Collective Ltd and its guests, as well as the staff, owners or other individuals at the retreat venue or nearby.
The Customer shall keep all properties, equipment, technological apparatus, and furniture used by Clariness Collective Ltd and other guests attending the retreat, in a clean and good condition. The customer shall replace any articles which are damaged, destroyed or missing with articles of the same kind and of equal value.
Clariness Collective Ltd reserves the right at its sole discretion to terminate use of any property or any of its facilities by the customer in the event of any breach of these terms and conditions. The customer will be required to vacate the property and Clariness Collective Ltd shall not refund payment or accept any consequential liability damages or loss.
Clariness Collective Ltd reserves the right to alter any facility, accommodation, facilitator, or retreat activity, as the Organisers and Clariness Collective Ltd best see fit.
The customer must comply fully with all and any health and safety regulations introduced by Clariness Collective Ltd. The Customer must ensure that they are medically and physically fit and able to use the facilities and participate in activities. Customers who have injuries or illnesses are advised to seek doctor’s advice if practicing yoga or other physical activities, including going on day trips. Clariness Collective Ltd is not liable for any injuries to the Customer in their use of the facilities of the retreat venue or participation in activities. A customer must always stop and rest if they are feeling any pain or sickness and inform Clariness Collective Ltd and/or any of the teachers or facilitators of the activities of any previous injuries and/or pregnancy. By signing this agreement the Customer understands that this Retreat and any of its activities are not professional medical help of any kind, and are not undertaken by medical professionals.
Clariness Collective Ltd cannot accept any responsibility for loss or damage of personal possessions or valuables of the customer. Any items gone missing, lost, or damaged should be reported to the Retreat Venue.
Clariness Collective Ltd shall not be liable for any failures beyond its control. This covers instances including but not limited to natural disasters, war, terrorism, closure of airports, civil strife, pandemics, endemics, accidents or failure to perform by third parties, including suppliers, subcontractors, and the Retreat Venue.
Clariness Collective Ltd accepts no liability for loss, damage, injury or illnesses which may be incurred during the Customer’s stay or travelling to and from the retreat the customer has signed up to attend.
It is the responsibility of all Customers to have adequate travel, cancellation and medical insurance for the duration of the Retreat, and any pre or post-retreat travel experiences they may have. Clariness Collective Ltd can accept no liability for customers. By agreeing to these terms and conditions the customer accepts that no type of insurance is covered by the cost of this Retreat, by Clariness Collective Ltd, or by any of the organisers involved.
COVID POLICY: Every single person attending the retreat will be required to take a rapid lateral flow COVID test upon arrival, right before entering the venue. Customers will only be admitted if you test negative for COVID-19. If you test positive for COVID-19, you will not be able to attend the retreat nor stay at the venue. Clariness Collective Ltd will not be able to refund a Customer if they test positive for COVID-19, and thus need to leave the venue. Everyone will be required to have an NHS Covid Pass, EU Digital Covid Certificate or equivalent. Clariness Collective Ltd might need to adapt to new covid regulations that might be imposed by the Catalan or Spanish government.
The Customer is responsible and liable for abiding and compiling with all principles of the law of the country where the retreat is taking place, at all times and under all circumstances.
The customer signing this agreement may not assign any of the aforementioned terms and conditions or sub-contract any of your obligations under this Agreement.
This Agreement shall be governed by and construed in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts.
